BACKGROUND

Background

On September 1, 2022, the Board of Commissioners approved to publish an upset bid notice based on an offer to purchase real property located at 5009 A NC HWY 150 E., Brown Summit, NC in the amount of $100,000.00.  Pursuant to N.C.G.S. 160A-269 (Negotiated Offer, Advertisement, and Upset Bids) an advertisement for upset bids was made.  On January 19, 2023, the Board of Commissioners voted to accept the highest offer of $260,000.00 from the Greensboro Batting Center, Inc (GBC). to purchase real property located at 5009 A NC HWY 150 E., Brown Summit, NC, as the highest bidder from the upset bid process.  GBC has been in an investigative period since the Board accepted their offer to purchase.  Pursuant to the January 19, 2023 Board action, GBC and Guilford County are now prepared to enter into a contract for the sale of the property.

REQUESTED ACTION

Requested Action

Approve in substantial form, the contract for the sale of real property located at 5009 A NC HWY 150E., Brown Summit, NC to Greensboro Batting Center, Inc., for $260,000.00 and authorize staff to take all reasonable and necessary steps to execute the contract and close on the sale of the property. Guilford County hereby consents to Greensboro Batting Center, Inc. applying for a  rezoning of said property. This consent is in no way an endorsement of the application, but rather in compliance with Section 3 M(3)(a) of the Guilford County Unified Development Ordinance. Greensboro Batting Center, Inc. shall have until May 20, 2024, to properly execute and deliver the contract as presented, else this sale process shall automatically terminate, all bids shall be rejected, and all deposits shall be returned.
