BACKGROUND
Background
The Guilford County Transportation department received an email on April 13, 2021 from the Safety, Education and Compliance manager with North Carolina Department of Transportation, Integrated Mobility Division (NCDOT/IMD) with revisions to the Drug & Alcohol Testing Policy. In accordance with federal and state requirements, NCDOT/IMD requires that all transit agencies have an updated Drug and Alcohol Testing policy. The policy requires the approval and adoption by the county's governing board.
Attached is the policy with the tracked changes received from NCDOT. Changes to this policy from the previous adopted policy are included on page 8 in Section E.1.a. Prohibited Substances and page 9 in Section F.1. Prohibited Conduct:
• Update to CFR policy reference from 21 CFR 1300.11 through 1300.15 to 21 CFR 1308.11 through 1308.15
• Additional language prohibiting the use of marijuana for medicinal or recreation purposes regardless of state laws
• Amended language regarding illegal use of drugs being prohibited at all times and prohibits employees reporting or remaining on duty regardless of minimum thresholds
