BACKGROUND
Background
The expense incurred by the County under its contract for foreclosure-related services with Mark D. Bardill, P.C. (D/B/A Zacchaeus Legal Services) is normally collected along with delinquent taxes before payment is due to the attorney, so that the County does not normally pay the expense out-of-pocket. Because collections have run higher than anticipated, the contract needs to be amended for the remainder of FY 2020-2021 from a maximum exposure of $300,000 to a not expected to exceed amount of $500,000 to ensure enough funds are available for projected work and the budget adjusted correspondingly. Funding for this increase will come from an increase in prior year tax revenue received as a result of work under the master contract. In 2016, the average number of delinquent years on an account assigned to ZLS was 8.5; that number has been reduced to an average of 2 years at present.

The existing contract Guilford County Contract No. 2566 Mark B. Bardill, P.C. d/b/a Zacchaeus Legal Services will be amended in substantial form as follows:

1. CHANGES. Section 21 entitled “Appropriation” is replaced by a new Section 21 which reads as follows:

1. “Price Only Contract/Appropriation. The County is not financially committed by this Contract to purchase any minimum amount of services. The financial exposure to the County under the provisions of this Contract and the former contract between County and Attorney, combined, is not expected to exceed $500,000.00 in any fiscal year and in any event, payment will be made only from budgeted funds in accordance with N.C. Gen. Stat. Chapter 159. Additionally, this agreement is subject to annual appropriation of funds by the Guilford County Board of Commissioners or other funding source, pursuant to N.C.G.S. Chapter §153A-13.”
