BACKGROUND
Background
On April 16, 2016 Guilford County, Alamance County and Randolph County entered into an Agreement to Participate in the Guilford County Sheriff's Office Aviation Program.(the "Agreement") This Agreement is attached as Exhibit 1. This ten (10) year Agreement, renewable annually thereafter, shared costs of operation for a Tecnam Eaglet Aircraft, Registration Number N731TE (the "Aircraft"). Randolph County subsequently withdrew from the Agreement. In 2018 the US Department of Justice published the 2018 Equitable Sharing Guide which now requires each agency to pay their respective costs for operation of the Aircraft directly to the service provider rather than pooling these payments. Essentially each agency cannot co-mingle federal forfeiture funds for this purpose. Therefore Alamance County and Guilford County will now adopt this Amendment to the Agreement to formalize that each agency will directly pay their share of the necessary costs of operation to the respective service provider. Attached as Exhibit 2 is the Amendment. This Amendment will not alter the term or any other portion of the existing Agreement.
