BACKGROUND

background

A-1 Sandrock, Inc. (A-1), was issued a franchise for its Construction and Demolition (C&D) Landfill on October 3, 2013 for a term of ten (10) years. A-1 Sandrock, Inc., in accordance with NCGS 130A-294(b1)(2) and the Guilford County Solid Waste Ordinance Chapter 15.5-5, is requesting a modification to its existing franchise to accomodate changes in A-1's recently-approved Special Use Permit Case #18-08-GCPL-04985 (see site plan and Special Use Permit attached) which allows for vertical expansion of the landfill from its original height of one-hundred fifty feet (150 ft.) up to and not to exceed one-hundred eighty-five feet (185 ft.).  Currently, A-1 employs approximately 35 full-time employees.  The C&D Landfill serves both the local and regional economies and accepts materials such as lumber, concrete, cardboard, stumps, bricks, asphalt, brush, pallets, studs, sheetrock, shingles, insulation, and plastic and paper packaging pertaining to construction products.

The requested franchise modification (attached) would:

1)                     Increase the volume of construction and demolition debris accepted at the landfill from a maximum of 300 tons per day (TPD) to 500 TPD;

2)                     Extend the franchise term limit from ten (10) years (approved in Oct. 2013) to life-of-site, not to exceed sixty (60) years, in accordance with NCGS 130A-294 (see SB162, Session Law 2017 attached).  The projected useful life of the landfill, measured from 2019, is approximately twenty (20) years given its current design and footprint;

3)  Accomodate the size of the facility and the landfill footprint.

Other considerations include:

                     A projection of the maximum closure costs at a point ten (10) years from the present is two million dollars ($2,000,000).  Under state law, this closure cost is evaluated, required, monitored and bonded through North Carolina Department of Environmental Quality (NCDEQ);

                     Closure and maintenance costs are the responsibility of A-1 Sandrock Inc.;

                     A-1 reports that its current standard tipping fee charged for C&D waste is $36 per ton and that it will report its standard rate schedule from time to time upon request;

                     A-1 Sandrock, Inc. has paid its $250 franchise fee; and

                     Landowners with connecting land have been notified by mail via. Fox Rothschild, LLP;
