RESOLUTION AUTHORIZING THE ADVERTISEMENT OF AN OFFER TO PURCHASE CERTAIN PROPERTY

WHEREAS, the Guilford County Board of Commissioners desires to dispose of certain surplus property;

NOW, THEREFORE, BE IT RESOLVED by the Guilford County Board of Commissioners that:

1. The following described property is hereby declared to be surplus to the needs of Guilford County: A portion of the property located at 307 North Edgeworth Street, as identified in attached map, and incorporated herein by reference.

2. Guilford County has received an offer to purchase as outlined in the attached offer, and incorporated herein by reference. The person making the offer must deposit with the County Clerk to Board a sum equal to a sum of 5% of his/her offer in addition to the conditions and other conditions set out in the attached documents and incorporated herein by reference.

3. The Guilford County proposes to accept the offer unless a qualifying upset bid shall be made.

4. The Guilford County Clerk to Board shall cause a notice of such offer to be published in accordance with applicable law.

5. Persons wishing to upset the offer must submit a written bid to the Guilford County Clerk to Board within ten (10) days after publication of the notice. The person making the bid must deposit with the County Clerk a sum equal to a value of five percent (5%) or greater of the proposed consideration including all terms and conditions.

6. If a qualifying upset bid is received, the Guilford County Clerk to Board is directed to re-advertise the offer at the increased upset bid amount, and to continue with this process until a ten (10) day period has passed without receipt of a qualifying upset bid.

ADOPTED this the 17th day of January, 2019.
