BACKGROUND

Background

North Carolina General Statutes (NCGS) 153A-340 were amended in 2017 to eliminate the United States Dept. of Agric. (USDA) Farm Service Agency’s Farm Identification number as sufficient evidence that property is being used for bona fide farm purposes (See attached Senate Bill 615).  Section 2-1 Definitions, of the Guilford County Development Ordinance, is recommended as such to comply with determining whether a property is being used for bona fide purposes (see attached revisions and staff report).  The Planning Board held its public hearing on December 13, 2017 and voted 8-0 to approve staff's recommendation for approval to comply with change in NCGS (Ayes:  Jones, Leonard, Collins, Hayworth, Alexander, Geter, Apple, Burnett. Nays:  None. Absent:  Mann).
