BACKGROUND
Background
The expense incurred by the County under its contract with Mark D. Bardill, P.C. is normally collected along with delinquent taxes before payment is due to the attorney, so that the County does not normally pay the expense out-of-pocket. This budget amendment recognizes and adds to the budget this revenue source for payments under this contract, as this revenue is not included in the current budget. The contract with Mark Bardill, P.C. will be amended consistent with this budget amendment. Of the total $200,000 amount to be budgeted under the contract with Mark Bardill, P.C. during this fiscal year, $185,000 is budgeted to come from the revenue resulting from the previous collection of the expense. The remaining $15,000 was already budgeted from County funds.
Amend Guilford County Contract No. 114209-11/16-195 Mark D. Bardill, P.C. d/b/a/ Zacchaeus Legal Services by replacing Section 21 with the following:
21. Appropriation. County and Attorney acknowledge and agree that the financial exposure to the County under this agreement is not expected to exceed $200,000.00 for fiscal year 2017/18. To this end, the total amount paid by County to Attorney for all fees and costs incurred under the provisions of this agreement shall not exceed $200,000.00 for fiscal year 2017/18 unless and until said amount is increased and approved by both parties and memorialized by a written amendment hereto. Additionally, this agreement is subject to annual appropriation of funds by the Guilford County Board of Commissioners or other funding source, pursuant to N.C.G.S. Chapter ยง153A-13.
