BACKGROUND
Background
During fiscal year 2012-2013, the Department of Transportation (DOT) initiated a condemnation action against property owned by Guilford County, situated on Oneida Road. Through the condemnation action by the DOT, the County was awarded $151,900.00 as just compensation. At the discretion of the Court, a Guardian ad litem was appointed to represent and protect the rights of any known or unknown heirs to this property, in the absence of a recorded property transfer into the name of Guilford County. The property had been on the tax records in the name of Guilford County since the 1930's. Upon the identification of heirs and through mediation, the parties entered into a Consent Judgment, filed on April 23, 2018, in which Guilford County would retain $71,900.00 as just compensation and redeposit $80,000.00 with the Clerk of Superior Court to be distributed to the identified heirs of the subject property.

Requested Action
Approve an increase of $80,000 in Appropriated Fund Balance in the County Building Construction Fund and appropriate the same amount to the Capital Building Construction Fund Level for the purpose of redepositing $80,000.00 in condemnation compensation with the Clerk of Superior Court.
