BACKGROUND
Background
Sections 4.7.3 and 4.7.4 of the Historic Preservation Commission (HPC) Rules of Procedure were revised by the HPC at its August 19, 2025 regular meeting (minutes attached) to reflect/clarify that historic Landmark Designations, in accordance with NCGS and the Unified Development Ordinance (UDO), are a legislative process (see attached). No changes to the UDO are required.
New text is shown with underline.
4.7.3 Type of Hearing
The HPC follows a legislative hearing process for Landmark Designations. The HPC follows a quasijudicial, evidentiary hearing process for formal review of Certificates of Appropriateness, which requires all testimony to be sworn, and which requires the HPC to conclude certain findings of fact before approving a Certificate of Appropriateness.
4.7.4 Hearing Procedure for Certificates of Appropriateness
The HPC shall conduct its hearings for formal review of Certificates of Appropriateness in accordance with the quasi-judicial, evidentiary hearing procedures of the Unified Development Ordinance.
