BACKGROUND
Background
N.C. Gen. Stat. §121-5 (c) and §132-8 directs local government to adopt and adhere to records retention and disposition schedules that are created and managed by the NC Department of Natural and Cultural Resources (NC DNCR). These schedules serve as an agreement between the local government office/department and NC DNCR, and provide guidance on the types of records to be maintained and for how long.
The 2026 County Register of Deeds Records Retention and Disposition Schedule, attached for review, will supersede the 2012 version, upon adoption. The 2026 County Register of Deeds Records Retention and Disposition Schedule, issued by the North Carolina Department of Natural and Cultural Resources on April 13, 2026, supersedes the 2012 County Register of Deeds schedule and is used in conjunction with the 2021 General Records Schedule for Local Government Agencies. The update reorganizes Register of Deeds records into five subject areas, updates statutory references, makes targeted changes to retention periods and disposition instructions, adds a Notice of Error records series, and clarifies transfer eligibility and preservation guidance for certain permanent and historical records. Most existing disposition requirements remain unchanged.
Staff request the Guilford County Board of County Commissioners approve the 2026 County Register of Deeds Records Retention and Disposition Schedule issued by NC DNCR to ensure compliance with statutory guidelines.
