BACKGROUND
The North Carolina General Statutes (NCGS) were amended in 2005 to allow Conditional Zoning as a non quasi-judicial rezoning tool/process for cities and counties. While Guilford County and Greensboro were the first in the State to have Conditional Use Zoning Districts in place, Guilford County has historically utilized a non quasi-judicial process for Conditional Use District Zoning (Since 2005, Conditional Use District Zoning has been clarified by NCGS and is considered a quasi-judicial process). Therefore, in keeping with Text Amendment 14-06-GCPL-02921, 07-09-14; a new text amendment has been developed to maintain the current process used by Guilford County (non quasi-judicial), and aligns the terminology/tool and procedures for Conditional Zoning in the County's Development Ordinance with NC general statutes and the non quasi-judicial process historically used in Guilford County.
During its February 10, 2016 Regular Meeting, the Guilford County Planning Board held a public hearing and voted unanimously (8-0) to approve Text Amendment Case #15-12-GCPL-06404) with a noted clerical correction in the Table of Contents on 3-13 and 3-13.1 (see attached meeting minutes).
Having been duly noticed the Board of Commissioners is asked to hold a public hearing regarding the recommended text amendments to the Guilford County Development Ordinances.

REQUESTED ACTION
Requested Action
Approve Text Amendment Case #15-12-GCPL-06404 to the Guilford County Development Ordinance to amend Articles ii, II, III, IV and IX, and all corresponding Table of Contents changing all references of Conditional Use Districts to read Conditional Zoning, and all Conditional Use (CU) acronyms to Conditional Zoning (CZ) acronyms, effective January 13, 2016.
Additionally, add new Section 4-2.3 (B) and (C) to read as follows:
(B) Existing Zoning Designations of “CU-” on the Official Zoning Map of Guilford County have been approved historically via a legislative process and thus will be considered and administered consistent with parcels designated as Conditional Zoning (CZ) as of [Insert the effective date of amendment.] Application: The Conditional Zoning classification will be considered only upon request of the property owner for rezoning.
