BACKGROUND

Background

On October 8, 2024 the Guilford County Board of Education (“the Board”) declared the property known as Pilot Elementary School and Shadybrook Elementary School located at 4600-4800 Chimney Springs Drive, Greensboro, North Carolina consisting  of approximately 2.3 +/- acres, unnecessary for public school purposes, and therefore surplus property, pursuant to N.C.G.S. §115C-518.

 

On October 8, 2024 the Guilford County Board of Education (“the Board”) declared the property known as Shady Brook Elementary School located at 503 Shadybrook Rd, High Point, North Carolina consisting  of approximately 0.6 +/- acres total, unnecessary for public school purposes, and therefore surplus property, pursuant to N.C.G.S. §115C-518.

 

The Pilot property identified as PINs 7832593672, 7832596961  and 7833601583 consists of 0.3, 0.83, and 1.17 acre portions respectively having been declared surplus by the Guilford County Board of Education. The portion declared as surplus is located north of US HWY 311 being a portion of  that certain property acquired by the Board of Education pursuant to the deed recorded at Deed Book 004267 Page 1399, Page 206 in the Office of the Guilford County Register of Deeds (the "Registry") and depicted on Plat Book 121, Page 100  of the Registry.

 

The Shadybrook property identified as PIN 6892625165 consists of 25.14+/- acres of land, with a 0.6+/- acre portion having been declared surplus by the Guilford County Board of Education. The portion declared as surplus is located along Chimney Springs Drive being a portion of that certain property acquired by the Board of Education pursuant to the deed recorded at Deed Book 2447, Page 206 in the Office of the Guilford County Register of Deeds (the "Registry") and depicted on Plat Book 48, Page 54  of the Registry.

 

Consistent with the requirements of N.C.G.S. §115C-518, the Board of Education is offering the property to the Board of County Commissioners (BOCC) in the event the BOC desires to purchase the property for fair market value. If the BOCC does not purchase the property, the Board of Education will proceed with the process for the disposition of public property outlined in the General Statutes.

 

County staff has performed an assessment of the property for potential uses. It is our opinion that Guilford County has no current need of the property in question.

 

The proceeds from the sale of property must either be applied to reduce the county's bonded indebtedness or for capital outlay purposes, pursuant to N.C.G.S. §115C-518.

Requested Action

Move to waive Guilford County's first right of refusal to acquire the portion of the property identified by the Board of Education as "the Subject Property" located at 4600-4800 Chimney Springs Rd Greensboro, North Carolina and 503 Shadybrook Rd High Point North Carolina as identified in the above agenda item and, in accordance with §115C-518, §115C-426, and Chapter 160A of the North Carolina General Statutes ALLOW the Guilford County Board of Education (BOE) to proceed with the process for negotiated offer as set out in Article 12 of Chapter 160A of the North Carolina General Statutes, in accordance with the "Resolution Declaring Surplus Property" adopted by the BOE on October 8, 2024.
