BACKGROUND

Background

The initial discussion concerning a definition for Private Clubs arose during the Planning Board’s June 12, 2024 regular meeting when considering a text amendment (TA 24-03-PLBD-00075) for recreational activities related to indoor and outdoor batting cages, recreational facilities and private clubs (subsequently approved by the Board of Commissioners at its July 21, 2024 regular meeting).  Subsequently, at its July 10, 2024 Regular Meeting, the Guilford County Planning Board recommended unanimously (minutes attached) to the Board of Commissioners the adoption of Text Amendment TA#24-06-PLBD-00087, as revised by the Planning Board, and presented herein (Ayes: Donnelly, Buchanan, Alston, Drumwright, Craft, Little, Gullick, Stalder. Nays: None. Absent: Bui).

This text amendment to the Guilford County Unified Development Ordinance (UDO), Subsection 12, Definitions, as referenced under Chapter 15, Article II, Section 15-56 of the Guilford County Code of Ordinances, clarifies what is considered as a Private Club for social, educational, or recreational purposes centered around recreational activities and not classified elsewhere in the Table of Permitted Uses. After considering several definitions for consideration presented by staff for Private Clubs (see minutes attached), the Planning Board selected the following definition that  will amend Section 12.04, Definitions, to add a definition for “Private Club Recreation” to read as follows: “Buildings and facilities owned or operated by a corporation, association, person, or persons for a social, educational, or recreational purpose, but not primarily for profit, which inures to any individual and not primarily to render a service which is customarily done as a business” (A Planners Dictionary, APA 2004). The term “Private Club Recreation” (reflects the revision made by the Planning Board to add the term “Recreation”) will distinguish this use type from other “private club” use types listed elsewhere in the table of permitted uses. This text amendment also reflects that private recreational services offered can help expand the recreational footprint in Guilford County.

If adopted, the two (2) corresponding amendments to Subsection 4, Zoning Districts, and Subsection 5, Development Standards for Individual Uses, will be required to reflect the new terminology and definition for Private Club Recreation use type.  First, an amendment to Table 4-1.3, Permitted Use Schedule will be required to change the listing for “Private Club or Recreation Facility, Other (incl. Indoor Batting Cages)” use type under the “Recreation and Entertainment (Light)” use category to “Private Club Recreation (incl. Indoor Batting Cages)” use type. The second corresponding change will be to amend Section 5.6.J to change the heading of the “Private Club or Recreation Facility, Other (incl. Indoor Batting Cages) use type to Private Club Recreation (incl. Indoor Batting Cages) use type.

A staff report and the full text of the proposed amendment is attached.

Text underlined indicates text to be added to the current ordinance. Text to be deleted is shown with strikethrough.

Consistency with Adopted Plans:

Text Amendment Case #24-06-PLBD-00087, as presented by staff and revised by the Planning Board, is consistent with the Guilford County Comprehensive Plan (effective October 1, 2006) Future Land Use Plan Element Goal #1, Objective 1.4, which states that “Guilford County will seek coordination and compatibility of land use plans among Guilford County, its incorporated cities and towns, and neighboring jurisdictions.”

Reasonable and in the Public Interest:

The recommended action to add a definition for Private Club Recreation and rename the listing for the “Private Club or Recreation Facility, Other (incl. Indoor Batting Cages)” use type to Private Club Recreation (incl. Indoor Batting Cages) reflects the new terminology/listing is reasonable and in the public interest because it supports the Guilford County Comprehensive Plan (effective October 1, 2006) Future Land Use Plan Element Goal #1, Objective 1.4, which states that “Guilford County will seek coordination and compatibility of land use plans among Guilford County, its incorporated cities and towns, and neighboring jurisdictions.” The proposed amendment will provide guidance and clarity in applying use and development standards for administering development review of recreation offered by private clubs.
