BACKGROUND
Background
Duke Energy Carolinas, LLC has requested an easement for installation and maintenance of electric communication facilities (“Facilities”) on County owned property located at 8020 Witty Road, Summerfield, NC (Parcel #138494). This County property was acquired in 2009, to be used as open space and passive park activities. There are no active County operations or functions located at this property.
Duke Energy Carolinas, LLC currently has Facilities along Witty Road and is seeking to replace certain components of the existing Facilities, which will impact the County property. Therefore, Duke Energy Carolinas, LLC is requesting an easement from the County for installation and maintenance of the electric communication facilities on County property. Duke Energy Carolinas, LLC is requesting a strip of land thirty feet (30') in uniform width for the overhead portion of said Facilities and a strip of land twenty feet (20') in uniform width for the underground portion of said Facilities, lying equidistant on both sides of a centerline, which centerline shall be established by the center of the Facilities as installed, along with an area ten feet (10') wide on all sides of the foundation of any Grantee enclosure/transformer, vault and/or manhole. Duke Energy Carolinas, LLC will be responsible to repair any damages to County owned property resulting from this installation. The County will have no responsibility to maintain the Facilities.

Requested Action
Authorize staff to enter into the requested easement, in substantial form, to Duke Energy Carolinas, LLC to allow the installation of overhead lines of electrical service located at 8020 Witty Rd., Summerfield NC, and authorize staff to take all reasonable actions to finalize and execute said easement.
